Does anyone know the laws on payday loans in Texas?
I missed several payday loans because I could not follow all my time and I cut a lot at work and I am two months behind on all my bills and can not not even afford these. One company called me and told me they were sending my check to the DA and I continue to hot checks, even if I have written with the intention to pay. I just fell on hard times. Can they do this even tho some practices that are illegal, as allowing the bearings, which are illegal in Texas. How can they sue me when they are wrong too?
The regulation of payday loans in Texas are governed primarily by the Texas Administrative Code (TAC) and the Texas Finance Code (TFC). In particular, you want to view Chapter 83 of the TAC Chapter 342, TFC, each of which focuses on consumer loans including payday loans. Links to the TAC and TFC are below. TAC: $ http://secure.sos.state.tx.us/pls/pub/readtac ext.ViewTAC? Tac_view = 5 & ti = 7 & pt = 5 & ch = 83 & sch = F & Rl = Y TFC: http://tlo2.tlc.state.tx.us/statutes/fi.toc.htm Take a look at statutes to determine if there are violations in your loan agreement. Without seeing your loan agreement, there is no way for anyone to give you a precise answer and background.
